Welcome to the first edition on Influx. A free commodore zine
written for the Commodore Pirates by Commodore Pirates. Influx was
created on the night on June 19,1988 around 11:00 pm with Candyman,
Infernal, Jimmy Z & myself. Influx will published around the 15th
and the 30th of each month but don't keep an eye on those dates.
My name is Nomaad and I am the self decreed tyrant or otherwhise
termed editor. Each issue will consist of at least 2 features and
about 9 departments. The departments may alter from issue to issue
The editorials and idea expressed may not represent the views of
editor or the staff of Influx. The sustenance of the articles is
purely for informational purposes. If you feel you have been
falsely wronged or such then you will have equal oppurtunity to
rebuttle the views as well. Anyone who has the talent or the
effort is encouraged to write for Influx. To contact Influx call
my voice mail box 305 228 9489 or any of the Infux Support Boards
that are listed below. Enjoy because this could be the start of
something totally cool.

So some pirates got together to write a magazine huh? Big deal,
whats the point. We are hoping to accomplish a few things here,
not the least being the acquisition of credits by uploading this
to good boards. The main aim is to inform, and the next is to
entertain. We intend to keep the pages serious enough to be
believable, but not so serious as to be an effective tranquilizer.
We will have facts, opinions and jokes labeled as such so you the
reader can distinguish them. If you dont like some of the things
you read, if they make you mad, and get you ranting and raving, we
are at least partially doing our job. If you have any disputes with
the articles in the magazine, be they factual disputes or disputes
on opinions, direct all responses, in letter form, to the bbs's
listed herein. We are currently looking for reporters to work for
Influx. If interested, leave feedback on one of the bbs's or in one
of the VMBs listed.
Thank You,
The Editors

Musings
Well, they want me to write an article for the premier edition
of this magazine huh? Seems kind of strange, me of all people
writing this article. 3 months ago, I had never heard of any of you
people, and really had no idea of what an elite board was. All in
all I am almost dissapointed at how easy the climb has been. I now
run a bbs that is legitimately 0-1 days, and that may not be a major
acheivement, but somehow I dont think a person should get this far
this fast. You should have to WORK at it some, not just dial and
trade for 90 days. At one time, not too far ago, I looked mystified
at title screens by such awesome groups as BBI and HSI.
Now I abhor the thought of getting the crap that they put out.
I would have never believed that I would actually someday TALK to
the likes of ESI members. Now it doesnt seem such a big deal. At
one time, anyone who ran a bbs and called itself elite intimidated
me. That has changed, but the sad thing is,it took too short a time.
I guess the whole idea behind this is that anyone can be elite if
they have a little time and like calling boards. Dont ya wish it
was a little harder? I know I do, especially now that I am most of
the way there....

The sysops side
By Candyman
A hell of a lot of you are sysops, and I think if you read this,
you will agree with most of it.
A sysops main concern is his bbs. He lives for his bbs, he
changes his underwear for his bbs. He breathes for his bbs. A normal
pirate, if he exists, gets a game because he wants it, to play, to
have, or whatever reason, the having the game is the central theme.
To a sysop, the central theme isnt the game or even having it, its
his BBS having it. God forbid it dont make it to your bbs the day
of the release,or dont even imagine it not getting there for 3 days.
The ultimate insult to a sysop is to upload him a good game he hasnt
gotten yet. He desperately wants you to send it, but at the same
time, he is sure he is superior to you, and it is just some weird
fluke due to the alignment of the planets that you had it first.
When you beg for credits, and that sysop gets mad, when you leave,
dont kid yourself, you made his day. Its not him giving you the
credits that makes him feel better, its you HAVING to ask. If you
really want to make him feel good, do it often enough and he will
have the ultimate enjoyment and delete you from the system. That is
where the real fun comes in.
I had the supreme pleasure of deleting a user once because he
didnt heed the nasty mail i sent him about sending old files. The
second time he did it, I hit the ole 'U' at the sysop command and
hit the 3 key, punched in the handle, and told it 'Y' when it asked
was I sure. I thought that was a lot of fun. The true fun is when
this particular caller dialed me on my voice line to ask why he was
deleted. When I told him, he literally cried aloud in anguish. I
may have been unhappy with my bbs to that point, but after that call,
I felt great. It wasnt in the causing of the pain that I took the
pride, it was in the system that was desired. Any sysop out there
reading this, always remember, if it werent for someone being lame,
you wouldnt be elite. If you didnt have to listen to em whine for
credits, that means they dont need what you have online. Be damn
thankful for the little lamers, they remind us all of the fact that
our boards are important to someone, and they have a habit of doing
it when we need it. After all, is it ever as much fun playing
a game if you get it a day old as it is if you get it first in the
country? Its not the games, its the chase.

Lamer'z Look
From the outside,looking in...
First off, what is it with spelling everything with a "z"? Latez?
Slatez? Slaterz? I mean, duh, what am I supposed to say to "Slaterz
on,duuuuuuuude." It's not exactly the queen's english,you see.
(editor's note warez, vmb'z & etc....)
I suppose this would brand a big scarlet "L" (for lamer) on my
forehead.
Anyway....I can remember a time when I was happy to get Green Valley
Software (and those of you who are truely elite will have NO IDEA
what Green Valley Software was).
Now, I'm seeing software at least six months before any of the
commodore magazines review it. The people at the local Commodore
Users Group think I'm a god. Their "hot shot pirate" showed me a
list of warez that was at least two years old...I showed him a box
of software I had brought along, and it was really funny, watching
lust creep all over Willie's face. While he was giving a demostration
of a print-shop type program,I was making a few copies of Test Drive
for some of the people there I knew.God,now I'm a stud.
Until recently, the only phone phreaker I've met was Cutter John...
nice kid, but at 4'9 inches,he kinda looks like Beaver Cleaver. Now
I've met other phreakers, and had the chance to chat with overseas
hackers (hi, steve)
You guys keep churning out the imports, because us leeches are never
full. One favor,tho...HOW ABOUT SOME 128 WAREZ,OKAY?!?!?!?!
One final note...if anyone has any digitized fotos of Connie Chung,
send them to the desert inn.Not that I can give ya any extra credits
but ya never can tell.....candyman sleeps REAL late.

Musical Pirates:
By Candyman
Well, this is the first installment of Musical Pirates. Leading
off the group has to be Kid Quick. First he goes from importing and
bbs'ing for Abyss, then he joins Epic. Next he quits Epic and forms
his own group. Then he quits his own group and joins Epic. Then he
quits Epic and joins Orion USA. Then Orion USA, following KQs lead,
changes its name immediately to AMW. Kid Quick immediately leaves
AMW and joins The Survivors, minus all but two members. I havent
seen that much hopping since Joan Collins got off the rag.
Other movers include:Peacemaker started off with IRS, quit IRS
to join TU. Took control of TU and changed the name to OUT, and
then quit to go with Public Enemy. This aint the end folks. Not
happy being a Public Enemy, he then quit to re-form TU(or OUT
which ever you wanna go with....). After that, he decided to go
ahead and join Abyss. He left Abyss to form Orion USA(with Kid Quick
no less) and they stayed in that group for a day. Then on to AMW and
now it seems that Peacemaker has joined the largest group taking new
members, BUSTED. Influx has not been able to confirm the rumor of
Peacemakers alleged bust, and at the writing of this article, we
have failed in our attempts to contact him.
Other movers:Blackbeard-TIC,Abyss,The Survivors, Orion-USA (with
Kid Quick & Peacemaker no less),The Survivors again,AMW,and now in
Illusion.(I think)
Sinbad-(in memory of)TWB ,NO ,SFX ,TAV(old) ,TAV(new), TU, FBR, PE,
then that growing group, BUSTED.
Once again Sinbads bust has not been confirmed by a trained medical
doctor.
Firewalker-(in memoriae) TWB, TEC, MWI, NFI, PE?, Epic and then
rumour has it he has quit pirating
There were lots of others, but I am too damn tired, and feel seasick
due to all the moving, so this is it for now.

My Opinion:By Candyman
A lot of people have been busted lately, and I have a few opinions
about it.
I dont think that at this point, there have been many people
turning in each other, I think that is just getting started. What I
do think has happened is this, I think that the Sprint backdoors
that people were using are coming back to haunt them. A hell of a
lot of people are getting billed, and they are turning people in to
avoid paying the bills. Its a chickenshit way to do it, but thats
the way it is. Be careful of any callers that you had as a sysop
who have suddenly quit calling your bbs. I would imagine that one of
the other things they did to get out of trouble with Sprint is to
quit doing what got em in trouble.
At one time, there was a phrase referring to honor among thieves.
It was never less valid than it is today.
Candyman
==============================================================================
From June 15th til June 20th the Commodore Pirate World got a
little tipped on its ass. We basically saw the end of one of
the better importing groups around, The Survivors. Satan, Dr.D,
Satan, & BlackBeard all left TS or America's Most Wanted to
form with two members of The Seventh Sector, Big Man & Intruder,
to form the new group Illusion. The group took possesion of
the old Survivor box only to loose it to some idiot name Enrico.
Illusion would later add Alleykat and round off there roster with
the Bermuda Triangle. Illusion has a nice start with Valentino
and Nerdload. Nerdload claiming to be the best utility program
ever written. Unfortunately there are several things which will
do the same thing as Nerdload but it is a new group and Satan's
Intro is real nice.
Other Pirate News Might be that Kid Quick quit EPIC on good
terms and he joined TS. To fill the gap EPIC quickly added
Candyman and his Board the Desert Inn. Good Luck to Both.
EagleSoft took on some new members such as Depeche Mode and
rumoured to be another Ghost Rider. In the past week Abyss
died and re emerged loosing its Amiga Cadre and Longshot/ABYSS.
Abyss may return to the importing game. Instinct joined up with
The Sorcerer to add to Public Enemys' posse.
June also saw the break up of what the world thought was a
stable pirate group, INC. INC with its 3 members and the best
contacts in Europe seemed to be set for life. But The Butcher
ran into problems with Shark and he left group, right before
Depeche Mode joins ESI. Butcher forms the group WHY? with John
Doe from ISE and Warlock. His 4 sided crack of Master Ninja was
rumoured to be false and Influx has had no confirmation either
way. Meanwhile Shark has redone INC by adding The Hunter formerly
of New Age, the Duplicator, and Xfactor, longtime formerly of
The Eternal Force. Rumour say JNP is a member but as yet this
hasn't been confirmed.
On a more sombre note. June also saw several pirates leave the
the pirate world. Being for long periods of time or just til they
need to come back they have gone. Rumour has it many have been
busted, narced, turned narc or gotten a social life. As usual
this is only hearsay and Influx can confirm nothing. Joing the
ranks of those been busted were Sinbad and Peacemaker. Regardless
off them, Both were fine importers and pirates. According to
YoungKing, the only king, Perplexer has quit because he can't
handle a full time job and pirating. But this is Perplexer's
second exodus. The first you remember was his quest for a social
life. Good Luck Perplexer, Sinbad, & PeaceMaker. Gone to Amiga
was Boba Fette and he may remain on 64 as well.
June was a rocked month for pirating many people left, alot
more came in. Groups started and ended. More importantly
came Influx.

Missing In Action
=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=
This little section is to see if anyone knows or thinks they
know where people we used to know have gone. Whether they got
arrested, billed, quit, or just got tired of it all. MIA members
are Natas Kaupas, Nightcrawler, JJ Breaker, Pantera, Head Banger,
and The KGB. These are people we all used to have fun with but not
anymore. Oh Well it may be none of our business but in pirating it
is all so easy to forget someone when they aren't around anymore.

The shell for restrict isn't /bin/sh
it's bin/rsh this is the restricted

are:
1. Cannot change directory(cd)

3. Cannot use a command containing/

Crack After Crack
Lately, there is an argument about
releasing a crack when it was already
been cracked.I don't think it's wrong.
Let me explain.
There are no rules governing pirate
groups.The understanding pirate groups
have between each other is that if
you screw up, you will not be
respected.And most pirates want
respect and recognition.
Most of the older pirate groups
crack to send their software to
other pirates so it can be enjoyed.
Most of today's pirate groups crack
to gain fame and soon the fame goes
straight to their heads.
I feel a crack should be released
after a crack if the first crack didn't
work,if there was limited distribution,
or if the newer crack has something
new to offer like unlimited lives etc.
etc.
The people that oppose cracking
after the crack say that there are
enough renames and shit files that
they don't need this. And they are
wrong. But this is not a rename we
are talking about here.The difference
between the file name of these cracks
are the last few letters which
determine who cracked the game.
The main point of piracy is to
distribute and recieve unprotected
software.When a pirate goes
onto a bbs and removes all of it's
software so that his group can release
their own version is absolutely 'lame'.
When a pirate group becomes more like
a software company then they are only
part of the problem and not the
solution.

FBR - The Formation
-------------------
Written by: Infernal!
Foreword:
---------
This article is dedicated to my
friends in FAC (Marcel), DCS, and
Future Project (Frans and Richard). I
was once a member of FBR. Ninja and I
shared the control of the group during
that time. It was either him or I that
would import all the softwares you see
at that time. Everything we would do
concerning the status of the group
resulted in a discussion with me and
him. There is a BIG difference between
the original FBR and the new FBR. In
this article I will take you back into
time when FBR was first born and
contributing to the import market. All the information here are written
truthfully. I believed I am very
qualified in writing this article since
I took part in leading FBR and knew how
it formed and how we functioned daily. I am merely recalling history as it has
happened.
*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*
Groups born fast and groups die fast!
But this is different when it comes to
FBR - (Fucked Beyond Repair). No other
'importing group' has ever contributed
to the importing community as much as
FBR, at that time. Many are curious
about the first formation of this
group. This article is written for that
purpose and to show the real difference
between the 'old original' FBR and the
'new' FBR.
The group was first formed during the
winter months of the year 1986,
(November, I believe). Its first
leading president and founder was 'The
Punisher', (Adam Cooper in Indiana). He
also formed or was a member in such
groups as - SSI (Silent Service Inc),
KOF (Knights of Fortune), and many
others. At this time he discussed with
Microman about forming a group
together. I believe Microman came up
with the name FBR. So after giving the
group a name, they needed importers.
That's where Ninja and I came in. They
gave Ninja a call and asked if he
wanted to join and indeed he did. After
giving him a call, they called me
(Infernal) and asked me if I wanted to
join. I gladly accepted their offer.
Then history took its place. The
first four original members were:
1. The Punisher (Adam) - President
2. Infernal (Me) - Importer & Artist
3. Ninja (Kevin) - Importer
4. Microman (Dave) - ???
As soon as the group formed, The
Punisher gave us ( Ninja and Me) many
of his contacts, ranging from
Headbanger to FAC (Federation Against
Copyright). Many people mocked us but
they will soon realize the truth and
consequences. People thought we could
not make it with such a name. They
thought the group was only a joke.
Maybe this was one of the forces that
intimidated us to prove that we are
better. From then on Ninja and I began
talking to Europeans about trading with
us exclusively and their replies were
'YES'. We began calling them up by the
dozens on conferences, such groups or
crackers as Triad, Headbanger, NSC
(Stephen / Non-Stop Cracker), Dynamic
Duo, TLC (The Light Circle), TMC, SCC
(Swedish Cracking Crew), 1001 Crew, DCS
and many others. We had an ambition to
take control of the importing market.
That ambition gave us the energy to
fulfill the goal. At that time I traded
with NSC (who also traded with Dynamic
Duo, TLC and other big shots), who
supplied us with most of the German
cracks. German cracks were big back
then. Cracks came out from German the
most. On the other hand, Ninja traded
with Headbanger (who also supplied us
with many softwares). We traded fairly
with everyone. We did not take anyone
for advantage. Anything that was out,
we sent it to our contacts. They
(Europeans) did the same for us. This
was the FBR system. We respected
everyone and every group and in turn
they respected us. FBR then began to
import more softwares and began to be
recognized and respected. Our only
competitor was KOF, but not for very
long. But as soon as they began to drop
out, we dropped in. At this time Ninja
losted Headbanger to the Amiga world.
He then looked for another group to
trade with, the group was Triad in
Sweden. I was still trading with NSC
and the German guys.
We needed a real programmer so
Microman went out to search for one and
came up with, YES!, 'Changeling', and
he was added in. Changeling (Jim) was a
poor programmer at that time but was
ambitious to learn and did. The
Punisher at this time resigned from FBR
due to personal difficulties at home. I
and Ninja then assumed leadership of
the group. 'We ran FBR and made it what
it was and is.' Ninja and I began to
look for more contacts to trade with.
We came up with Triad and TCB (The
Commodore Boys) and we added in The
Invincible Importer, who was an
American with an American system in
Holland. Anything that was cracked by
anyone in Holland was given to us by
him. Many groups such as RAD and KOF
tried to steal him but failed.
I then feel that we needed another
programmer in the group. I met Death
Demon (Bruce) somewhere on a bridge and
began talking to him. I gave him my
number and told him to give me a call
and he did. After talking to him for a
while, I believed that he could
contribute to FBR. I asked the other
members of the group if they wanted him
in. All but one accepted him. Microman
felt that we did not need another
programmer but I did. I added Bruce in
anyway regardless of what any members
said. Now this was THE FBR in its
climax.
The FBR membership list were:
1. Infernal (Me)
2. Ninja
3. Microman
4. Changeling
5. Death Demon
6. Invincible Importer (Brian/Holland)
After TCB began giving us only
failure. We felt that FBR needed
another contact. Ninja began trading
with Triad now and was pouring imports
in from them. He traded with them
exclusively. I on the other traded with
my friend Marcel of FAC. I imported
almost every crack from the mainland of
Europe from Marcel in Holland. The
cracks ranged from Hotline, TMC,
Apha-flight, New Edition, FCS and all
the mainland European crackers. Ninja
imported from the outland of European,
cracks ranging from Triad to Fairlight.
We put out almost everything possible
but there were few cracks that escaped
from our hands to other small groups.
FBR was the BEST at this point with the
combined work of Ninja and me. Credit
goes to where it is due!
To prove to the world that we were
not just a typical American group. We
asked our programmers to show their
skill(s). We did not want to be just 'a
group.' We wanted to be 'The Best
Group.' Changeling came out with demos
entitled: 1. Negative Earth
2. Ground Zero
Death Demon also released his demos
entitled: 1. High Voltage
2. Abstract Reality
From then on people began to
recognized and respect us. We gave our
contacts and friends whatever came out.
Imports began pouring from Ninja and
me like rain and was this way for many
many months.
As time passed by...
That final and sad day came when
Ninja received a call from MCI in
Georgia concerning illegal calls made
by him. They threatened him and demand
that he stop or will be prosecuted and
he was. They had his voice number and
continously called him up to harass him
and attempted to pull informations out of him. Never the less he kept on calling out.
I then got hit by MCI because I was
hacking into their local system. They
gave me no warning calls or anything
like that. Approximately 4 to 6 Feds
came over to my house and confiscated
my equipments. After being BUSTED
people everywhere (I don't even know
their names) called me up and asked for
my contacts. I felt that someone I know
should have my contact. That someone
was Boba Fette (Pat). I saw that he
needed to join a group since the break
up of TC (The Cult). I made him a
member of FBR and he took my place of
importing from FAC (but not from
Marcel). He traded with Rocky of FAC and maybe someone else. Marcel is now in the U.S. enjoying his stay and
traveling around. Things were different
without Marcel. At this time Ninja was
still calling out and trading with
Fairlight, until he was busted. After
he was busted he placed Oooowaahool
(Joe) - however you spell it! After the
two of us were busted, the remaining
FBR members failed to keep FBR at the
position it was a before. This was the
NEW FBR. Boba Fette broke away and
formed the group called 'The Survivors'
and Changeling broke away to form along
with Doppleganger 'Abyss'. The NEW FBR
was NEVER again like what FBR was
before. So in reality,
Does 'The Legend Continue'???
You answer that question! Maybe we
will make a survey concerning this
issue and make an article about it...
Until then...Later!

Foreword:

This article is dedicated to my friend Marcel of FAC. He was the
last person I talked to before I was busted and imported my last
import 'Starforce Nova' for FBR from him. This Bud's for you, Marcel
*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*-*
Many people have wondered 'Will I ever be busted?'. By phreaking
or hacking you are taking that risk but hey 'Who cares?'. The day
most pirates and hackers dread the most is that final day when a
dozen of guys in blue suits come knocking at your door and flash
their badges. In this article I will tell you exactly how I got
busted and all the detailed informations.
At the time when this incident occurred, I was still a member of
FBR. I phreaked daily to import many of the softwares for FBR.
Shortly about 4 to 5 days after my 17th birthday, I was hacking into
my local MCI system trying to find access codes and I was successful
but only for a while. MCI (with the cooperation of South Central
Bell System) placed a 'pin register' ( in normal pirate terms, a
fucking tap!) on my line. On August 7th, 1987 - 7:30 pm, I decided
to go out to the movies but it was packed so I decided to come back
home and then was forced to cut the lawn in the back-yard. While I
was mowing the lawn, my little brother came up to me and said 'FBI
and TBI are here!'. Thinking that this was a joke, I told him to
shut up but he repeated it again. This time it stopped my heart. I
dropped my weed-eater and rushed into the house and was faced with 4
to 6 guys in vests and one muscular guy in a white T-shirt with the
arms of my waist. As soon as they saw me, they quickly flashed their
badges and identified themselves as TBI (Tennessee Bureau of Invest-
igation) and FBI. There were only two words in my mind, 'Oh Shit!.'
There were three guys upstairs with me and the rest were downstairs
packing and confiscating my computer equipments in 4 to 5 big card-
board boxes. While sitting down with the other three guys upstairs,
they asked me if I was an American citizen and what my age was. They
told me that I do not need to talk if I don't want to. No they did
not read me my rights. So if someone tells you, 'They have to read
you your rights!', that's CRAP! Unless they physically arrest you,
they don't have to. The FBI agent commented to me by saying 'Odom,
if you were 18 now... You know you would be arrested, don't you?'
I replied 'Yes I do.' All these guys were real cool to me (not
harassing me that is!) but the dickhead of the whole group was the
South Central Bell Security Agent. This guy was a dick! Out of his
briefcase he pulled out a receipt list about as long as 50 feet long
(approximately). On the list were MCI codes that my hacker tried
hacking out. But the officials only got me on two days of hacking
and nothing else (not even phreaking). I did not phreak those two
days and thus they could not charge me on phreaking. I have been
phreaking for about four years but they only caught me on hacking
for two days. The telephone security agent began asking me all sorts
of questions like 'Where is your hacker disk?' I replied back by
'I don't know!' This only angered him and I thought to myself
(They're confiscating my disk and it's all labeled. I might as well
tell or the asshole'll try to be a bigger asshole.) While the three
guys were asking all the routine informatioins such as what school
do I go to, my occupation and ETC, the other guys were downstairs in
my room with cardboard boxes confiscating my equipments. They took
everything but my phonebook which was under my bed (Thank God!), but
they only took one computer system. I had two, one to run a BBS and
one to import, draw ,and compact. These are the following items they
confiscated from me (I'm reading exactly from my receipt they gave
me)
1 Commodore 64
1 Panasonic Easa-Phone
1 Commodore 1670 modem
1 Power panel - 6 sockets
1 1541 Disk Drive
1 Boxer fan
1 Okidata 120 printer (with stand)
1 Sony Trinitro Color TV
1 Quick-Shot joystick
1 Computermate Floppy Disk Box
Containing 93 Floppy Disks
1 Box Containing one cartridge
(Isepic), one Star-Point Software
Disk, 3 integrated circuits (1001 Card-Crunch and my Crack-Card)
1 Maxell Plastic Floppy Disk Storage
Box containing 16 floppy disks
1 ALS Industries plastic Floppy Disk
Storage Box Containing 63 disks
1 Family Products Red Plastic
Container with 147 Floppy disks
1 One Black Cartridge with Garbage
Pail Kids sticker on front
(My Mach-5)
1 One Blue Cartridge labeled with
yellow label 'The Final Cartridge'
1 Joystick - Atari Brand
2 Commodore Menu Cards
1 Disk Box Containing 150 disks
1 Yellow Sheet of Paper Containing
MCI codes
1 Instruction Booklet For Master
Modem - Containing MCI codes
1 Steno Pad Sheet of Paper Containing
Handwritten MCI codes
They only they left me was my surge protector and my desk (Wow!).
My other computer system was in the same room but they did not
confiscate because it had nothing to do with my hacking. So they left
it alone (Thank God!). After all this happened, we called our family
attorney and discussed about it.
As Time Passed By...
About a fucking year!
I waited that long and finally my court date came and I was summoned
to appeared in Juvenile Court on Tuesday, June 7, 1988 - 1:00 pm.
After discussing with my attorney before the court case,he told that
they will keep my computer system and will not return it back. He
told me I MIGHT be prosecuted by both the State of Tennessee and MCI
but so far only the state and I will be placed on Level 2 probation.
He also told me that they might make me pay around $700 to $1000
about 2 weeks before the court case.It took 2 hours to get the
court ready and 5 minutes for the case to be heard. All the routine
informationa were heard by the judge. I pleaded 'Guilty'(of course).
Not knowing that my attorney and the District Attorney who was
prosecuting me already worked out the court case by themselves, I
was shocked of how easily I got off the hook. We also knew the
District Attorney too, she used to take my sisters to school in her
car pool... Lucky heh? All I have to pay was a $50 court fine and a
little part of my life. Well now I am on Level 2 probation which the
court has jurisdiction beyond my 18th birthday. My curfew is 11:00 pm
each night. If I stay out of trouble, they will literally clear my
record so no one can ever see it again. So now I don't phreak and
won't ever again. Anyone must be stupid if they phreak again after
they were caught. Why phreak again to have your name on record?
You're playing with your career and life. For a first offense they
probably won't do anything to you but for a second? Who knows?
I don't want to know. I send my regards to those who do phreak..Just
be careful guys!
Before ending this article... I will give you an example copy of the
Search Warrant that they gave me. I will not reveal anyone's name,
the special agent or mine. This is the exact duplicate of the one I
have.
Affidavit of Special Agent Xxxx Xxxxx
Tennesee Bureau of Investigation
The affiant, 'agent', is a Special Agent for the Tennessee Bureau
of Investigation and has been employed as a Special Agent for
fifteen years.
On August 8, 1987, Southern Central Bell Security, Nashville,
Tennessee, related to this agent that he had received notification
from MCI investigation that illegal access to the MCI Data Procesing
System was being attempted by ODOM via his home telephone line in
Nashville, TN.
South Central Bell Security placed a 'pin register' on the
telephone line 615-333-3381 which is identified as a 'data' line at
South Central Bell records.A 'pin register' is a device which record
all dial out attempts from a telephone. From this telephone number,
some type of data processing system has attempted to extract data
from the MCI Computer System in Nashville, TN. The data processing
system attached to the telephone number 333-3381 has randomly
attempted to gain valid 5-digit MCI authorization numbers. The 'pin
register' tape documents several hundred attempts to gain valid MCI
authorization numbers during the period of August 5, 1987 at 5:29 pm
through August 6, 1987 at 3:30 a.m. Additinally, a following 'pin
register' tape documents several hundred additonal attempts to gain
valid MCI authorization numbers during the period of August 6, 1987
at 10:59 a.m. through August 7, 1987 at 12:52 a.m. This system has
been 'hacking' or attempting to extract data from MCI during this
period.
The attempts to gain valid MCI authorization numbers were made in
random order and the use of access numbers was also changed at
random. MCI officials advised that numerous valid authorization
numbers were obtained during the period that the attempts were made.
Also, Odom nor anyone at address, is an authorized MCI customer.
South Central Bell records reflect that 615-333-3381 is installed
in a residence located at 'address', and is a non-published, data
line, number for Odom. Further investigation reflects that the
activity originating at this address over telephone line is in
violation of TCA 39-3-1404.
Wherefore, for the foregoing reasons and the totality of the
circumstances, your affiant requests a search and seizure warrant
for 'address.'
Your affiant therefore prays that a search warrant be issued on
the above facts for the seizure of said items or any part thereof,
and that the same be brought before this court provided by law.
